Parkrose ordered to restore lost wages, benefits

In November, the Oregon Employment Relations Board (ERB) rejected a request by the Parkrose School District (PSD) to reconsider its ruling that the district violated state law when it imposed 16 furlough days on classified employees without collective bargaining.

The ERB ordered the district to restore lost wages and benefits to about 200 Parkrose classified employees.

“The district has filed an appeal of this decision with Oregon Court of Appeals; it also filed a motion to stay the payment,” said Parkrose Superintendent Karen Fischer Gray. “We really aren't doing anything until we hear back from ERB about the stay. After that, I can provide more information if the stay does not go our direction.”

In June 2012, the district imposed eight furlough days for the 2011-12 school year and eight furlough days during the 2012-13 school year on its classified (non-teachers) employees.

In response, the Oregon Schools Employees Association (OSEA), the union representing classified employees, filed an unfair labor practice.

The ruling established PSD broke the collective bargaining agreement when it refused to bargain with classified employees regarding proposed furlough days.

“The mess the administration finds itself in is one of its own making,” said Hal Meyerdierk, field representative for the OSEA, which represents Parkrose classified employees. “We raised the issue repeatedly; their refusal to bargain led to this.”

OSEA sought to clarify how the proposed furlough days would affect classified employees as early as the fall of 2011, he said.

“The decision clearly shows how the chapter made several efforts to bargain with the district,” said Rick Doyle, president of OSEA's Parkrose chapter. “The truth is, had the administration followed the law and bargained proposed furlough days, the district could have avoided this whole thing.”

The Oregon School Employees Association is an affiliate of the AFL-CIO, the American Federation of Teachers and the American Association of Classified School Employees.
